RE: PRESS RELEASE - PLATTEKILL MAN INDICTED FOR FORCIBLE RAPE AND
CRIMINAL SEXUAL ACT AGAINST ELDERLY WOMAN IN HOME INVASION
Brandon Devaux, 27, of 38 Country Pond Lane, Plattekill, was indicted Thursday, December 12, 2013,
by an Ulster County Grand Jury for Rape in the First Degree, Criminal Sexual
Act in the First Degree and Burglary in the First Degree, all violent
felonies. The indictment will supersede
a previous one count indictment for Burglary in the Second Degree handed up less
than two weeks after the offenses were committed.
The first indictment for burglary was presented to
the Grand Jury, immediately, in order to maintain the defendant’s incarceration
status. The two week delay in submitting the sexual assault charges to the
Grand Jury was due to the need for the forensics to be completed. The forensic
units, such as those dealing with DNA and fingerprints, expedited their
analysis so the Grand Jury could have additional evidence to consider prior to
the expiration of their term at the end of the year.
The
defendant will be arraigned in Ulster County Court at a date to be
determined. If convicted, the defendant
faces a substantial state prison sentence and would be required to register
under the New York State Sexual Offender Registration Act.
The case is
being prosecuted by Special Victims Bureau Chief Katherine R. Van Loan. The defendant is represented by the Ulster
County Public Defender’s Office.
