The Appellate Division, Third Department has today unanimously affirmed the August 3, 2012 conviction of James Hasbrouck upon a plea of guilty of the crime of criminal sale of a controlled substance in the third degree.

In August, 2011, defendant made two sales of crack cocaine to an undercover officer and confidential informant in the City of Kingston.  In exchange for his plea to criminal sale of a controlled substance in the third degree, defendant was sentenced by County Court Judge Donald Williams to a determinate four and one-half year sentence followed by two years of postrelease supervision. 

On appeal, the defendant argued only that the agreed upon sentence imposed by County Court was unduly harsh and excessive; this claim was, however, rejected by the Appellate Division. 

On appeal, defendant is represented by Cliff Gordon, Esq. of Monticello, New York.  Assistant District Attorney Joan Gudesblatt Lamb, Esq. handled the appeal for the District Attorney’s Office.

Press Release - Devin Gray

RE:  PRESS RELEASE - PEOPLE V DEVIN GRAY

Devin Gray, (age 20), of 184 Bayard Street, Port Ewen, was indicted by the Ulster County Grand Jury on charges stemming from a shooting in the City of Kingston which occurred on June 3, 2014.

Gray was charged by the Grand Jury with two counts of Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, and Reckless Endangerment in the First Degree. The incident occurred at approximately 1:50 AM on June 3 near the parking lot at Stuyvesant Charter Apartments in the City of Kingston. 

The indictment alleges that Gray possessed and fired a 9 MM assault weapon during an altercation with Eric Harris. Harris was also charged by the Kingston Police Department with numerous felonies as a result of the incident. The charges against Harris are pending action before a separate grand jury.

During the altercation Gray was shot by Harris. He was taken to Albany Medical Center, treated, and subsequently released. Both Harris and Gray remain incarcerated in the Ulster County Jail.

Criminal Possession of a Weapon in the Second Degree is a class C violent felony which carries a minimum sentence of three and a half years and a maximum sentence of fifteen years in state prison. Devin Gray is represented by Thomas Petro and the matter is being prosecuted by Senior Assistant District Attorney Gerard Van Loan.

    

Press Release - People v Torjuan McClain

RE: TORJUAN McCLAIN

Torjuan McClain, age 25, was sentenced to 15 years in state prison with 20 years post release supervision in Ulster County Court by the Hon. Donald A. Williams on his conviction to Rape in the first degree. In addition, he will be required to register as a sexual offender.  An order of protection was issued for the victim. 

The case arose from an incident that took place in Forsythe Park in the City of Kingston on June 13, 2013.  At the time of this incident, the victim in this case was homeless.  “A crime of this nature requires a specialized response by law enforcement and the community.” Through a coordinated effort of Kingston Police Department, the Ulster County District Attorney’s Office Bureau of Special Victims, the Crime Victims Assistance Program and Family of Woodstock, the victim was able to secure safe housing, temporary emergency services and employment while assisting in the successful prosecution of this case.

Pursuant to civil rights law section 50(b), the identities of the victims, shall be kept confidential.

   
   

Press Release - Beware Summer Scams

Summer is finally here and it’s a great time for vacation and home repairs, but don’t let scammers ruin the fun.  The Ulster County District Attorney’s Division of Consumer Affairs warns about popular summer scams the public should be aware of.

·        Vacation scams: Fake travel agents and websites use too-good-to-be-true deals only to take your money. Whether it’s a fake timeshare rental or a bogus Florida vacation, don’t let a vacation scam take you for a ride. Make sure the offer is legitimate by verifying the name, address and reputation of the company.

·        Moving scams: What is the mover’s reputation? Before moving your household goods movers are required to give you the booklet entitled Your Rights and Responsibilities When You Move.  Copies of this booklet can be downloaded from the website www.protectyourmove.gov.

·        Concert ticket scams: Be wary of sellers who offer a sad tale as to why they cannot use the tickets, only accept cash, want the money wired, and/or pressure you to act quickly.

·        Door-to-door scams: What is the address, name and reputation of the company? Get all promises in writing. Never sign a contract that has an open-ended completion date or blank spaces.

·        Employment scams: Be wary of employers who require fees for training and background checks, or who tout “no experience needed.”

Press Release - David Delisio

SUBJECT: PRESS RELEASE – DAVID DELISIO

On June 12, 2014, a jury of 5 men and 1 woman convicted David Delisio, of Olivebridge, New York, age 65, of 21 counts of the class A misdemeanor of Overdriving, Torturing, and Injuring Animals; Failure to Provide Proper Sustenance in violation of New York Agriculture and Markets Law section 353. 

The jury found that the defendant failed to provide necessary sustenance to twenty-one dogs that he kept in a barn on his property.  The dogs, ranging from forty pounds in weight up to ninety pounds were housed in a room in the barn that measured no more than twenty-three by twenty-five feet.  The conditions of the barn were discovered when it caught fire on June 7, 2013.  When firefighters responded to the fire they discovered in the barn piles of animal feces, garbage, and the rotting carcass of a dog that defendant testified had died approximately a month prior to the June 7^th fire. During the trial Assistant Fire Chief Terry Elmendorf testified that there were more animal feces present in the barn than he had observed on working livestock farms.  Sadly, all twenty-one dogs that the defendant kept in the barn perished in the fire. 

The trial occurred in the Town of Olive Justice Court and was presided over by Justice Timothy Cox.  The case was prosecuted by Assistant District Attorney Lisa Bondarenka.  The defendant was represented by Russell Schindler. 

Sentencing has been adjourned to July.
