The
Appellate Division, Third Department has today unanimously affirmed the August
3, 2012 conviction of James Hasbrouck upon a plea of guilty of the crime of
criminal sale of a controlled substance in the third degree.
In
August, 2011, defendant made two sales of crack cocaine to an undercover
officer and confidential informant in the City of Kingston. In exchange for his plea to criminal sale of
a controlled substance in the third degree, defendant was sentenced by County
Court Judge Donald Williams to a determinate four and one-half year sentence
followed by two years of postrelease supervision.
On
appeal, the defendant argued only that the agreed upon sentence imposed by
County Court was unduly harsh and excessive; this claim was, however, rejected
by the Appellate Division.
On
