RE: PRESS RELEASE – MALCOLM JEMMOTT SENTENCING

Malcolm Jemmott, age 48, of Queens, was sentenced in Ulster County Court today upon his conviction by a jury verdict in October, 2014, of Criminal Possession of a Weapon in the Second Degree and two counts of Criminal Possession of a Weapon in the Third Degree.

Jemmott received the maximum sentence of fifteen years in state prison followed by five years of post-release supervision on the top count of the violent felony of Criminal Possession of a Weapon in the Second Degree. He was sentenced to the maximum of three and one half to seven years on each count of Criminal Possession of a Weapon in the Third Degree. All sentences will run concurrently as required by law under the facts of this case.

Jemmott was arrested by members of the Kingston Police Department in September of 2010 after two individuals flagged a police officer down on Franklin Street following an encounter with a man threatening them with a gun. The loaded nine-millimeter handgun was located in a van that the defendant was using in a parking lot on Pine Street a short time before school was to be let out in the afternoon at nearby George Washington Elementary School. 

Jemmott previously entered a guilty plea to these same charges in 2011 and was sentenced to 12 years in state prison. However, his conviction was overturned by the Appellate Division, Third Department, after the appellate court ruled that his right to an attorney was violated during questioning by the police. After the conviction was reversed, the matter was tried in Ulster County Court in October of 2014.

Jemmott has an extensive criminal history from New York City dating back to 1985. Along with a number  of misdemeanor convictions Jemmott has 2 prior violent felony convictions for robbery and 2 prior firearms convictions.  He also has a number of drug charges.  This offense is the first crime Jemmott committed in Ulster County.

Jemmott was represented in the case by Thomas Melanson and the matter was prosecuted by Senior Assistant District Attorney Gerard Van Loan.

Press Release - Devin Gray Sentence

RE: PRESS RELEASE – DEVIN GRAY

Devin Gray, age 21, of 184 Bayard Street, Port Ewen, was sentenced by the Ulster County Court today on charges stemming from a shooting in the City of Kingston which occurred on June 3, 2014.

Gray was sentenced by Judge Donald Williams to 15 years in state prison followed by five years of post-release supervision upon his conviction of Criminal Possession of a Weapon in the Second Degree following a jury trial last December.

The crime occurred at approximately 1:50 AM on June 3 near the parking lot at Stuyvesant Charter Apartments in the City of Kingston.  At that time, Gray possessed a 9 MM assault rifle which had a pistol grip and was able to accept a detachable magazine. The weapon was used during an exchange of gun fire with an individual known as Eric Harris. Harris was also charged by the Kingston Police Department with numerous felonies as a result of the incident. Harris is being prosecuted by a special prosecutor appointed by the Ulster County Court.

Devin Gray was represented by Thomas Petro and the matter was prosecuted by Senior Assistant District Attorney Gerard Van Loan.

Press Release - Steffon Williams and Clarence Davis Plea

RE:  PRESS RELEASE – PEOPLE V. STEFFON WILLIAMS & CLARENCE      DAVIS

On February 27, 2015, Steffon Williams and Clarence Davis pleaded guilty in Ulster County Court to Robbery in the Second Degree for their roles in the robbery of the Rondout Savings Bank on Schwenk Drive in the City of Kingston on July 25^th, 2014.  

On that date, Williams and Davis entered the bank shortly after 11:00 a.m.  Williams approached the teller station with a bag and demanded that the tellers fill the bag with money and they complied.  Davis followed Williams into the bank and positioned himself at a desk of an assistant branch manager.  He warned the assistant manager that nobody would be hurt if she kept her hands on the desk.  After the robbery, Williams and Davis fled the bank to a vehicle that was waiting for them in the lot of a nearby apartment complex.  A third man, Cinque Mandela, has been indicted as the getaway driver.  His indictment is still pending.

The case was investigated by the City of Kingston Police Department and is being prosecuted by Chief Assistant District Attorney Michael Kavanagh. 

Press Release - Ryan Noval Plea

RE:  PRESS RELEASE – PEOPLE V. RYAN NOVAL

On February 25, 2015, Ryan Noval pleaded guilty in Ulster County Court to Robbery in the First Degree as a result of an incident that occurred on August 27^th, 2014 in the Town of Wawarsing.  

Noval and his girlfriend, Nicole Halter, were arrested after 911 received a call reporting that a woman had sustained a gunshot wound.  Members of the Ulster County Sheriff’s Office responded and located the female who reported that she was shot by Noval as she fled from him after he robbed her with a shotgun.  Noval fired one round from a shotgun at close range through the rear passenger side window of the victim’s vehicle as she drove away.  The victim was struck in the back but was able to drive from the scene and report the incident.  Noval and Halter were located shortly thereafter in a residence where Noval had barricaded himself.  After a brief standoff, Noval surrendered to authorities without further incident.  The victim sustained non-life threatening injuries.

The case is scheduled for April 28^th, 2015 in Ulster County Court for sentencing.

The case was investigated by the Ulster County Sheriff’s Office and is being prosecuted by Chief Assistant District Attorney Michael Kavanagh. 

Press Release - Tyler J. Grable Indictment

RE:  PRESS RELEASE – PEOPLE V TYLER J. GRABLE

     The Ulster County Grand Jury has handed down a multiple count indictment against Tyler J. Grable, age 22, of 3 Romney Way, Cottekill, NY.  Grable has been charged with Manslaughter in the Second Degree, four counts of Vehicular Manslaughter in the Second Degree, and four counts of Vehicular Assault in the First Degree. 

     The charges stem from a two vehicle collision at the intersection of Cottekill Road and Lucas Avenue in the Town of Rosendale on September 26, 2014. Grable was operating a 1999 Subaru sedan which collided with a 2006 Jeep Liberty. The driver of the Jeep was killed as a result of the crash. A front seat passenger in the Jeep Liberty, the victim’s 19 year old son, was injured in the crash. The intersection is a four-way stop.

     The case was investigated by the Ulster County Sheriff’s Office, the New York State Police, and the Ulster County District Attorney’s Office.  The charges contained in the indictment allege that the defendant operated his vehicle recklessly, while under the influence of alcohol and/or drugs, and in so doing caused the death of another person.
