Press Release - Kenneth Stahli Appeal

The Appellate Division, Third Department has unanimously affirmed the June 4th, 2015 conviction by jury verdict of Kenneth Stahli for Murder in the Second Degree. 

The case arose as a result of the bludgeoning death of a two year old boy, which occurred on August 5th, 2014.  The investigation revealed that the defendant was the primary daytime care provider of the infant.  The child was discovered non-responsive by his aunt on August 5th, 2014.  The ensuing investigation revealed that the infant suffered multiple blunt force traumas including more than 80 visible bruises, internal injuries to his brain, spine and eyes, and died as a result of internal bleeding, which was caused by a lacerated liver and pancreas.

On appeal, Stahli argued that the verdict was against the weight of the evidence.  He also argued that his sentence of 25 to life was excessive.  In affirming the conviction, the Court rejected each of the defendant’s arguments. 

On appeal, the defendant was represented by Paul J. Connolly, Esq.   Marleen Tuczinski, Esq. of the New York Prosecutor’s Training Institute represented the People.
