RE: TAQUAN “TAY” WEBB INDICTMENT

Taquan “Tay” Webb was arraigned in Ulster County Court, today, on an indictment charging him with Murder in the Second Degree.  Webb has been indicted as an accomplice in the 2014 Easter Sunday shooting of Ryan Gray at Murphy’s Bar in New Paltz.  Previously indicted in the case was Basheem Bennett who pled guilty to the murder charge in December of 2014 and awaits sentencing in County Court.

Webb was assigned the Ulster County conflict defender to represent him. His case has been adjourned to February 26^th.

Press Release - Jesse Soyka-Hutting Conviction

SUBJECT: PRESS RELEASE

On January 16, 2015, Jesse Soyka-Hutting, age 21, of Wallkill, NY, was found guilty by an Ulster County jury of Burglary in the Second Degree, Grand Larceny in the Fourth Degree, and Criminal Possesion of Stolen Property in the Fourth Degree. Soyka-Hutting was arrested by members of the New York State Police at Highland on September 12, 2013.

The evidence at trial established that Soyka-Hutting and an accomplice broke into a residence in the Town of Shawangunk and stole a guitar, guitar amplifier, shotgun, and iPod radio, among other items. Soyka-Hutting was found to have sold the stolen shotgun to a colleague at work. When interviewed by the police, defendant first denied going into the home but when confronted with the fact that he sold the shotgun and that some of the homeowner’s property was found in his possession, he admitted to going into the residence, but claimed it was only to use the bathroom.

Sentencing is scheduled on March 24, 2015 in front of Judge Donald Williams. He faces a sentence of up to fifteen years in prison. The case was prosecuted by Assistant District Attorney Paul Derohannesian. The defendant was represented by attorney Randy Siper.  

Press Release - Sidney Joyner Plea

SUBJECT: PRESS RELEASE – SIDNEY JOYNER PLEA

On January 15, 2015, Sidney Joyner, 25, entered a plea of guilty to Criminal Possession of a Forged Instrument in the Second Degree, a Class D Felony, in Ulster County Court.  On July 25, 2014, Joyner, a resident of the Bronx, entered Nekos-Dedrick’s Pharmacy in uptown Kingston and attempted to pass forged prescriptions for Oxycodone, Promethazine and Flexeril.    After a brief foot pursuit, Joyner was arrested by members of Kingston Police Department.  He was found to be in possession of additional forged prescriptions and Oxycodone.  The matter was adjourned for sentencing until February 19, 2015 at 1:00 p.m.

Press Release - David Moors Sentence

SUBJECT: PRESS RELEASE – DAVID MOORS

On January 15, 2015, David Moors, age 40, of 134 Beachwood Blvd, Beachwood, New Jersey, was sentenced to a period of 6 months in jail, to be followed by a period of 5 years probation by Ulster County Court Judge Donald Williams. Moors also is to perform 250 hours of community service, ordered to surrender his hunting license and his weapons, and to pay $2,363 in restitution to Clara’s family. Moors was previously convicted after a bench trial in front of Judge Williams for the crime of Aggravated Cruelty to Animals. The evidence at trial established that on October 27, 2013, while hunting on his sister’s property in Walker Valley, Moors shot a two and a half year old dog, Clara, with a field point arrow in the back.  Clara staggered back to her owner who immediately rushed her to the hospital. Clara died on the way to the veterinary hospital.

In a somewhat bizarre twist, at sentencing Moors attorney suggested his client perform community service at an animal shelter which prompted a response from Judge Williams that he (the judge) could not imagine what animal shelter would want Moors to serve as a volunteer.

The case was prosecuted by Assistant District Attorneys Paul Derohannesian and Michael Kavanagh. The defendant was represented by attorney Jerry Flaherty.  

Press Release - Taxable and Exempt Foods and Beverages

RE: PRESS RELEASE - TAXABLE AND EXEMPT FOODS AND BEVERAGES

Most food is exempt from sales tax, according to the New York State Department of Taxation and Finance. The exemptions include:

·       Food products  (e.g., condiments, salad dressings);

·       Dietary foods;

·       Health supplements; and

·       Certain beverages (e.g., coffee, tea, milk)

Foods must meet these conditions to be exempt from tax:

·       It must be sold for human consumption;

·       It must be sold unheated; and

·       It must be sold in the same form and condition, quantities, and packaging as is commonly used by retail food stores

These foods and beverages, however, are not exempt from tax:

·       Candy and confectionary;

·       Alcoholic beverages;

·       Soft drinks, fruit drinks, sodas, or similar beverages;

·       Heated or prepared meals (sandwiches, salad bars, etc.); and

·       Food or beverage sold for on-premises consumption
